ELIGIBILITY: The Genesee Ambassador Contest (“Contest”) begins at approximately 12:00:01 AM Eastern Time ("ET") on 03/11/2024 (“Start Date”) and ends at 11:59:59 PM ET on 03/18/2024 (“End Date”) (“Promotion Period”). Contest is open to all legal US residents of New York who are 21 years of age or older at time of entry. This Contest is sponsored by Genesee Brewing Company, Rochester, New York (“Sponsor”). Employees of Sponsor along with their respective parents, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies (collectively, “Released Parties”), any person affiliated with the alcoholic beverage industry, including but not limited to retailers of alcohol products, and their immediate family members (spouses, domestic partners, parents, children, and siblings) and household members of each (whether related or not) are not eligible to participate in or win the Promotion. Eligibility is limited to natural individuals and therefore not open to corporations, LLCs or other business organizations, non-profits, or any groups, clubs or organizations. By participating, entrants agree to these Official Rules and the decisions of the Sponsor.

HOW TO ENTER: To enter the Contest, during the Promotion Period, (i) visit www.geneseebeer.com/ambassador and provide your full name, date of birth, street address (PO Boxes are not acceptable), city, state, zip code, phone number, email address; (ii) use the web form to enter social media handles as required; and (iii) explain your love for Genesee and why you wish to be a Genesee Ambassador (iv) tell us about your social circles; (v) tell us if you have every visited the Genesee Brewhouse in Rochester, New York; (vi) if you are chosen as an ambassador tell us how you would promote Genesee; (vii) while not required, videos and pictures to supplement your application are encouraged. No beer purchase is necessary to participate. Limit of one (1) entry per person (collectively, the “Entry”) Entries made using automated entry devices of any kind will be disqualified. Eligible entries must be received by the close of the Promotion Period.

SUBMISSION GUIDELINES: Each Entry that is submitted to this Contest must comply with the following Submission Guidelines to be eligible. Any Entry that, in Sponsor’s sole and absolute discretion, violates these Official Rules or the Submission Guidelines below will be disqualified and/or will not be eligible to win a prize. By participating in this Contest, entrant grants Sponsor permission to use: (a) his/her name, likeness, and photograph, (b) her/his team name, and (c) the names, likenesses, and photographs of the other persons appearing in the Entry for future advertising and publicity purposes in any and all media without additional compensation, notification or permission, unless restricted by law. Such future advertising and publicity may include, but is not limited to, Sponsor’s future social media posts and point of sale material. By participating in this Contest, entrant also represents he/she has obtained all necessary permissions to grant Sponsor permission to use the name, likeness, and photograph of any others pictured in the Entry.

If you have the following social media accounts please make your platforms public. The Entry MUST, include the following information and/or follow the below guidelines; in the sole discretion of Sponsor:

The Entry must NOT, in the sole discretion of Sponsor:

• Contain content that violates or infringes upon another’s rights, including but not limited to privacy, publicity or intellectual property rights (including, without limitation, trademark or copyright infringement), without permission.
• Disparage Sponsor or its products or services, Sponsor’s competitors or their products or services, or any other person or party affiliated with the Contest.
• Contain company names, product names, brand names or trademarks other than those owned by Sponsor, which participant has a limited license to use for this Contest.
• Contains the names, likenesses, or other indicia identifying any celebrities and/or other public or private figure, living or dead, without permission.
• Contain content that is inappropriate, indecent, obscene, profane, hateful, tortious, defamatory, slanderous, controversial or libelous.
• Contain content that displays or promotes illegal drug use, irresponsible alcohol use, bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age.
• Contain content that is unlawful, in violation of or contrary to applicable laws or regulations.
• Contain any photograph or reference to any person under twenty-one (21) years of age; and/or Contain content in which the Released Parties do not wish to associate themselves with, in their sole discretion.

 

JUDGING CRITERIA: Sponsor will review all eligible Entries and will select ambassadors from those that are creative, unique, showcase the most love for Genesee, and meet all the Submission Guidelines and Genesee brand values.

PRIZES AND DRAWINGS: On or around 04/1/2024 and subject to confirmation of eligibility, there will be up to ten (10) Ambassadors selected from a pool of all eligible entries received (each, a “Ambassador” or collectively, the “Ambassadors”). Each Ambassador will be notified by phone, text-message, email or direct message and entrants hereby consent to such notification by entering into this Contest. Each Ambassador will be awarded the following prize (the “Prize”):

The Approximate Retail Value (“ARV”) of each Prize is $194.00. If ten (10) Winners are chosen, the total ARV of all Prizes is $1,940.00. All Prizes will be awarded unless Sponsor cannot obtain documentation from a potential Ambassador to prove eligibility in which case all Prizes may not be awarded. Ambassador is responsible for all costs and expenses incurred that are not specifically stated as being included as part of the Prize including, but not limited to, all taxes, surcharges, and all other costs and expenses not specifically stated as being included. Prize will be mailed to Ambassador at residence provided by Ambassador. No alcohol is being awarded as a Prize.

CONDITIONS: Ambassador must be 21 years of age or older at time of entry. Sponsor need not inform you if you have earned an entry or not. All Federal, State, and local laws apply. Incomplete entries, entries generated by script, macro or other automated means, or entries which subvert the entry process, in the sole discretion of Sponsor, will not be eligible. Entrants shall not enter Contest to become an Ambassador or use the Rewards Program for commercial or business purposes, or to violate laws regarding the regulation of alcohol. All entries must be received during the Promotion Period to be eligible. Message and data rates may apply. The computer clock of the webmaster hosting the Contest is the official timekeeping device. Sponsor reserves the right to substitute the Prize with a prize of equal or greater value or with a company check in the amount of the ARV for the Prize. If requested, Ambassador must return to Sponsor a signed Affidavit of Eligibility and Liability/Publicity Release. If Sponsor is unable to receive personal confirmation from a Ambassador of being selected as a Ambassador within three (3) days from the first notification attempt, or if a Ambassador (i) fails to complete and return all requested documents by the date specified by the Sponsor, (ii) is found to be ineligible, or (iii) fails to comply with the Official Rules, the Prize will be forfeited and an alternate Ambassador will be selected. The acceptance or use of the Prize constitutes permission for Sponsor to use Ambassador ’s name and address (city and state) for promotional purposes on a worldwide basis, and in all forms of media, in perpetuity, without notice or further compensation. All federal, state and other taxes are the responsibility of each Ambassador. Sponsor does not provide tax advice. Prizes awarded may not be exactly as shown or described. No substitutions are allowed and the Prize may not be transferred, conveyed or auctioned. All Prizes will be awarded unless Sponsor does not receive required documents in a timely manner in which case all Prizes may not be awarded. Ambassador s agree to release, discharge, indemnify, and hold harmless the Sponsor, Meta Platforms Inc., Twitter Inc., and their respective parent companies and affiliates and their respective directors, officers, employees, and agents, from any claims due to any injuries, damages or losses to any person (including death) or property, resulting in whole or in part from acceptance or use of the Prize, or participation in the Contest. No purchase is necessary. A purchase will not increase chances of winning. Becoming a fan or clicking the “Like” button on the Sponsor’s page does not constitute an entry into this Contest and it will not increase changes of winning. Following the Genesee social media accounts does not constitute an entry into this Contest and it will not increase chances of winning. Message and data rates may apply if using a mobile device. ENTRANT WARRANTY AND RELEASE: Each entrant warrants that they are eligible to participate in this Contest and has the legal capacity to agree to the terms of these Official Rules. Ambassador agrees to release, indemnify, and hold harmless the Released Parties from any and all liability, injuries, losses, or damages to any person (including death) or property, arising from or in connection with the awarding, receipt, use, and/or misuse of a prize or participation in any prize-related activity, and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property related cause of action.

LIMITATIONS ON LIABILITY: Released Parties are not responsible for lost, late, jumbled, incorrect, or inaccurate entries, whether caused by any of the equipment or programming associated with or utilized in this Contest or by any human error. Sponsor is not responsible for any problems or technical malfunction(s) of any telephone network or lines, computer online systems, servers or other services, providers, computer equipment, software, failure of any e-mail, technical problems or traffic congestion on the Internet or at any website (including Instagram and Twitter), including, without limitation, any injury or damage to participant's or any other person's computer related to or resulting from participation in this Contest. Sponsor is not responsible for any typographical or other error(s) in administration of the Contest, or in the selection/announcement of the prize Ambassador s. If, for any reason, the Contest is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest. Should the Contest be terminated prior to the stated expiration date, notice will be posted where Sponsor deems fit and the prizes will be awarded via random drawing from among all eligible Entries received up until and or after (if applicable) the time of modification, cancellation or termination, or in a manner that is fair and equitable as determined by Sponsor. All entries become the property of the Sponsor and will not be returned to entrants. The Contest is subject to all applicable federal, state and local laws. Any person attempting to defraud or in any way tamper with the mechanics or logistics of this Contest will be declared ineligible and may be prosecuted. Sponsor is not responsible for lost or stolen Prizes. If, for any reason, the Contest is not capable of being conducted as planned because of tampering, intervention, fraud, technical failures, or any other reason (each an “Intervening Cause”), which affects the security, fairness, or proper execution of the Contest, Sponsor reserves the right to modify or cancel the Contest or otherwise award the Prizes through a drawing from all eligible entries received which, in Sponsor’s discretion, were not affected by the Intervening Cause. Regarding the Prize being awarded, Sponsor makes no express or implied warranty of merchantability or fitness for a particular purpose. In the event that a court, or other tribunal of competent jurisdiction, shall hold any of the provisions of these Official Rules to be illegal, invalid, or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Official Rules shall otherwise remain in full force and effect.

DISPUTE RESOLUTION: Any disputes regarding this Contest shall be governed by New York State law and resolved in State or Federal court located in Erie County, New York. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred but in no event attorneys’ fees. Entrant waives any claim for punitive, incidental and consequential damages. BY PARTICIPATING, EACH ENTRANT UNDERSTANDS AND AGREES THAT THEY MAY BRING A CLAIM AGAINST THE RELEASED PARTIES ON AN INDIVIDUAL BASIS ONLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.

Any Prize manufacturer and its dealers do not endorse Sponsor’s products and are not affiliated with this Contest.
