ELIGIBILITY: The Roc Trivia Circuit Contest 2023 Contest (“Contest”) begins at approximately 5:00 PM eastern time on 01/23/2023 (“Start Date”) and ends at 11:59PM eastern on 12/31/2023 (“End Date”) (“Promotion Period”). Contest is open to legal US residents who are 21 years of age or older at time of entry. This Contest is sponsored by High Falls Operating Co., LLC d/b/a Genesee Brewing Co, Rochester, New York (“Sponsor”). Sponsor and all of their respective officers, directors, representatives, employees, and agents, advertising/promotion agencies, alcoholic beverage licensees, and the parent, subsidiary, and affiliated companies of the foregoing entities (collectively, the “Released Parties”), and each of their immediate family members of the foregoing employees, are not eligible to participate in this Contest. By participating, entrants agree to these Official Rules and the decisions of the Sponsor.
HOW TO ENTER: To enter the Contest, during the Promotion Period, visit one of the following venues (the “Venue” or “Venues”) at the specified times and dates below (subject to change upon Sponsor’s sole discretion) and follow the on-site instructions for how to enter:

Each of the above a “Trivia Night”. There is no fee to participate, and no beer or other purchase is necessary to participate. The final trivia night for the grand prize is invite only based on the below rules and will take place on December 13, 2023 at 6pm EST at Radio Social, 20 Carlson Road, Rochester, NY 14610 (the “Final”). Dates, times, and locations of the Events and Final are subject to change based on Sponsor’s sole discretion. Sponsor will communicate such changes via it’s social media, if necessary and may or may not update these Rules.
TRIVIA GUIDELINES: Each Participant to this Contest must comply with the following Guidelines to be eligible to win a Prize along with on-site instructions at each Venue. Any Entry that, in Sponsor’s sole and absolute discretion, violates these Official Rules or the Submission Guidelines below will be disqualified and/or will not be eligible to win a prize. By participating in this Contest, entrant grants Sponsor permission to use his/her name, likeness, and photograph, for future advertising and publicity purposes in connection with this Contest in any and all media without additional compensation, notification or permission, except where restricted by law.
- Participants must be 21 years or older at the time of the Promotion Period.
- Upon arrival at a venue Participants will form teams of up to 8 people maximum (“Team”).
- There will be a limit of teams per Trivia Night dependent on the capacity of the Venue and Sponsor’s reasonable discretion.
- A participant may participate in more than one Trivia Night on the same or different Team but may only qualify once for the Final.
- Trivia Night Rules:
- 5 Categories of 6 questions each (30 in total).
- Categories will change each Trivia Night and will be announced when the Trivia Night starts.
- Each Question is worth 1 point.
- Five bonus rounds will be played each Trivia Night with 1 point available for each bonus round.
- The maximum score is 35.
- The Team with the most points wins.
- In the result of a tie, a random bonus trivia question will decide the winning Team.
- The winning Team from each Trivia Night will receive prizing described below and a “ticket”, which qualifies the Team to go to the Finals.
- If a Team participates in and wins more than one Trivia Night, the second place Team will go to the finals (you can only win Trivia Night prizing and qualify for the Final once).
- If a winning Team from any Trivia Night cannot attend the Final Sponsor reserves the right to offer the spot to the second place Team from such Trivia Night.
- Participants may not use their phones or internet during Trivia Nights or the Final unless directed to by Sponsor.
- Sponsor reserves the right to disqualify a Participant or Team for acting inappropriately or not following these Guidelines or any instructions provided at the Venue.
- Final Rules:
- 5 Categories of 6 questions each (30 in total).
- Categories will change each Trivia Night and will be announced when the Trivia Night starts.
- Each Question is worth 1 point.
- Five bonus rounds will be played each Trivia Night with 1 point available for each bonus round.
- The maximum score is 35.

PRIZES AND DRAWINGS
Trivia Night Prizing
As described in more detail above, there will be one winning Team per Trivia Night (for a total of 11 Teams), subject to confirmation of eligibility, (each a “Qualifying Team”) will be awarded Genesee merchandise valued at $100 (per Team) and a ticket, which qualifies them to compete in the Final (the “Trivia Night Prize”). Each Qualifying Team will be notified in person at the end of the Trivia Night at the Venue and consent to such notification by entering into this Contest.

Final Prizing
As described in more detail above, there will be one winning Team for the Finals, subject to confirmation of eligibility, (each a “Winning Team”) will be awarded a $300.00 gift card to the Genesee Brewhouse, a trophy, and 8 t-shirts (the “Final Prize”). The Winning Team will be notified in person at the end of the Final at the Venue and consent to such notification by entering into this Contest.

The total ARV of all prizes is $1,600.00.
The odds of winning a Trivia Night Prize and Final Prize will depend on the total number of Participants at the Venue. All prizes will be awarded unless Sponsor cannot obtain documentation from a potential Qualifying Team or Winning Team to prove eligibility in which case such prizes may not be awarded. A winning Qualifying Team and the Winning Team is responsible for all costs and expenses incurred that are not specifically stated as being included as part of the prize including, but not limited to, all taxes, surcharges, and all other costs and expenses not specifically stated as being included. Prizes will either be mailed to Qualifying Teams and Winning Team at residence provided or at the Venues. No alcohol is being awarded as a Prize.
CONDITIONS: All Participants must be 21 years of age or older at time of entry. Sponsor need not inform you if you have earned an entry or not. All Federal, State, and local laws apply. Incomplete entries, entries generated by script, macro or other automated means, or entries which subvert the entry process, in the sole discretion of Sponsor, will not be eligible. All entries must be received during the Promotion Period to be eligible. Message and data rates may apply. The clock used by Sponsor hosting the Contest at the Venue is the official timekeeping device. Sponsor reserves the right to substitute any prizing with a prize of equal or greater value or with a company check in the amount of the ARV for the Prize. If requested, Qualifying Team or Winning Team members must return to Sponsor a signed Affidavit of Eligibility and Liability/Publicity Release. If Sponsor is unable to receive personal confirmation of being selected as a member of a Qualifying Team or Winning Team within three (3) days from the first notification attempt, or if a member of a Qualifying Team or Winning Team (i) fails to complete and return all requested documents by the date specified by the Sponsor, (ii) is found to be ineligible, or (iii) fails to comply with the Official Rules, the Prize will be forfeited and an alternate winner will be selected. The acceptance or use of the prizes constitutes permission for Sponsor to use Winner’s name and address (city and state) for promotional purposes on a worldwide basis, and in all forms of media, in perpetuity, without notice or further compensation. All federal, state and other taxes are the responsibility of each member of Qualifying Team or Winning Team. Sponsor does not provide tax advice. Prizes awarded may not be exactly as shown or described. No substitutions are allowed and the prizes may not be transferred, conveyed or auctioned. All prizes will be awarded unless Sponsor does not receive required documents in a timely manner in which case all prizes may not be awarded. Members of Qualifying Team or Winning Team agree to release, discharge, indemnify, and hold harmless the Sponsor, Facebook Inc., and Instagram, Inc. their respective parent companies and affiliates and their respective directors, officers, employees, and agents, from any claims due to any injuries, damages or losses to any person (including death) or property, resulting in whole or in part from acceptance or use of the prizes, or participation in the Contest. No purchase is necessary. A purchase will not increase chances of winning. Following or clicking the “Like” button on the Sponsor’s page on Facebook or Instagram does not constitute an entry into this Contest and it will not increase changes of winning. Following Sponsor’s page on Instagram account does not constitute an entry into this Contest and it will not increase chances of winning. Message and data rates may apply if using a mobile device. ENTRANT WARRANTY AND RELEASE: Each entrant warrants that they are eligible to participate in this Contest and has the legal capacity to agree to the terms of these Official Rules. Members of the Qualifying Team or Winning Team agrees to release, indemnify, and hold harmless the Released Parties from any and all liability, injuries, losses, or damages to any person (including death) or property, arising from or in connection with the awarding, receipt, use, and/or misuse of a prize or participation in any prize-related activity, and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property related cause of action.
LIMITATIONS ON LIABILITY: Released Parties are not responsible for lost, late, jumbled, incorrect, or inaccurate entries, whether caused by any of the equipment or programming associated with or utilized in this Contest or by any human error. Sponsor is not responsible for any problems or technical malfunction(s) of any telephone network or lines, computer online systems, servers or other services, providers, computer equipment, software, failure of any e-mail, technical problems or traffic congestion on the Internet or at any website (including Instagram), including, without limitation, any injury or damage to participant's or any other person's computer related to or resulting from participation in this Contest. Sponsor is not responsible for any typographical or other error(s) in administration of the Contest, or in the selection/announcement of the prize winners. If, for any reason, the Contest is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest. Should the Contest be terminated prior to the stated expiration date, notice will be posted where Sponsor deems fit and the prizes will be awarded via random drawing from among all eligible Entries received up until and or after (if applicable) the time of modification, cancellation or termination, or in a manner that is fair and equitable as determined by Sponsor. All entries become the property of the Sponsor and will not be returned to entrants. The Contest is subject to all applicable federal, state and local laws. Any person attempting to defraud or in any way tamper with the mechanics or logistics of this Contest will be declared ineligible and may be prosecuted. Sponsor is not responsible for lost or stolen Prizes. If, for any reason, the Contest is not capable of being conducted as planned because of tampering, intervention, fraud, technical failures, or any other reason (each an “Intervening Cause”), which affects the security, fairness, or proper execution of the Contest, Sponsor reserves the right to modify or cancel the Contest or otherwise award the Prizes through a drawing from all eligible entries received which, in Sponsor’s discretion, were not affected by the Intervening Cause. With regard to the Prize being awarded, Sponsor makes no express or implied warranty of merchantability or fitness for a particular purpose. In the event that a court, or other tribunal of competent jurisdiction, shall hold any of the provisions of these Official Rules to be illegal, invalid, or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Official Rules shall otherwise remain in full force and effect.
DISPUTE RESOLUTION: Any disputes regarding this Contest shall be governed by New York State law and resolved in State or Federal court located in Erie County, New York. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred but in no event attorneys’ fees. Entrant waives any claim for punitive, incidental and consequential damages. BY PARTICIPATING, EACH ENTRANT UNDERSTANDS AND AGREES THAT THEY MAY BRING A CLAIM AGAINST THE RELEASED PARTIES ON AN INDIVIDUAL BASIS ONLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.

SPONSOR: High Falls Operating Co, LLC d/b/a Genesee Brewing Co Rochester, New York is the sole Sponsor of this Contest. This Contest is in no way sponsored, endorsed, or administered by Venue. Any Prize manufacturer and its dealers do not endorse Sponsor’s products and are not affiliated with this Contest. Any trademarks or trade names used are the property of their respective owners and are used for purposes of prize description only.
